Photo Contest - Terms & Conditions

  1. Eligibility: Open for Rediscovery Photo Contest (the "Contest”) is open to those who are 18 years of age or older as of the date of entry. The Contest is only open to legal residents of United States and is void where prohibited by law. Employees of the Downtown Boulder Partnership (DBP), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
  2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of DBP as final and binding as it relates to the content of this Contest.
  3. Contest Period: Entries will be accepted online starting on June 8, 2021 at 8:00 AM MST and ending August 31, 2021 11:59 PM MST. All online entries must be received by August 31, 2021 11:59 PM MST.
  4. How to Enter: The Contest must be entered by tagging photos with both #OpenForRediscovery and #DowntownBoulder on Facebook or Instagram accounts. One photo equals one entry. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.  Alternative entry: email images to info@downtownboulder.org. 
  5. Prizes: A total of three winners (the “Winner” or "Winners") will be selected in the Contest. One winner will be chosen by DBP staff via random drawing on July 6, 2021, August 2, 2021 and September 1, 2021.  Winners will be notified through Facebook or instagram (or email address if alternative entry is used.) Prizes will be mailed or will be available for pickup at the Downtown Boulder Visitor Information Center. The Downtown Boulder Gift Card is accepted at over 125 participating downtown businesses. No cash or other prize substitution shall be permitted.
  6. Winner Selection and Notification: Winners will be selected via random drawing each month by DBP staff. Winner will be notified via entry within five days following selection of Winners. DBP shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 3 business days from the time award notification was sent, the prize may be forfeited, and an alternate Winner selected. Receipt by Winner of the prize offered in this Contest is conditional upon compliance with any and all federal, state, and local laws and regulations.
  7. Your Rights: You will retain all rights to any photograph you submit — including ownership if applicable. By submitting photos in the Contest, You grant DBP a royalty-free, nonexclusive right, in perpetuity, to: use the photograph on the Internet in support of our mission; use the photograph in DBP’s non-commercial communications, promotions and public art displays; use the photograph in DBP-related news stories, newsletters, reports, slide shows, displays, web pages, and the like; use, in connection with the Contest, Your name, city, state and country of residence in promotions and other publications; and keep the files provided, and to archive the images on CD or in other electronic forms, so that Your photos can be used to support our mission and be properly credited. As conditions of this permission, DBP shall credit each photograph with the participating Contestant's name. Please do not submit images that are not your own. 
  8. Terms & Conditions: DBP reserves the right to modify award packages as needed. DBP reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond DBP’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, DBP may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by DBP. DBP reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. DBP has the right, in its sole discretion, to maintain the integrity of the Contest. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, DBP reserves the right to seek damages to the fullest extent permitted by law. 
  9. Limitation of Liability: By entering, You agree to release and hold harmless DBP and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
  10. Winners List: To obtain a copy of the winners’ names or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Downtown Boulder Partnership, 1942 Broadway, Suite 301, Boulder, Colorado 80302. Requests must be received no later than October 31, 2021.
